On Thursday, January 14 the U.S. Court of Appeals for the Seventh Circuit ruled that Justin Reed, an Illinois railroad technician may be able to proceed with a Federal Railroad Safety Act (FRSA) retaliation lawsuit.
Reed said that he was coerced by a work supervisor to sign a document stating that the company wasn’t responsible “severe abdominal pain” that he experienced at work in April 2009. After taking seven months of medical leave to recover from his abdominal condition, he was fired from work.
Reed challenged his dismissal by filing an FRSA complaint to the Occupational Safety and Health Administration (OSHA), before filing a lawsuit in the U.S. District Court of for the Northern District of Illinois.
