A jury in Coles County, Illinois awarded a 19-year-old disabled teen and her parents $40 million last Thursday for birth injuries suffered during childbirth. Plaintiff suffered severe injuries including herniated discs that required a cervical discectomy, a left shoulder impingement necessitating arthroscopic shoulder surgery, and reflex sympathetic dystrophy, which required a permanent implantation of a spinal cord stimulator. - $1,000,000.00 – Personal Injury

Female – 80 years old – was walking her dog when an unrestrained neighborhood dog engaged with the Plaintiff’s dog, causing her to fall and fracture her right hip. Under the Animal Control Act, the owner of an animal is held liable when the animal “attacks or injures” any person peacefully conducting themselves in a place where they have the legal right to be. Illinois courts have held that an actual “attack” on a person is not required to state a claim and that one can bring an action for any injury stemming from an animal’s conduct resulting in an injury to the plaintiff. - $202,268.99 Personal Injury
Female – 48 years old – was ascending the steps of an apartment when she tripped and fell due to the defective steps, which were improperly maintained in violation of the Uniform Building Code. The fall caused her right arm to go through a window, which severely lacerated the arteries, nerves and ligaments in her wrist. The lacerations resulted in permanent deformity to her arm/hand.

Male -19 years old- Entered an unmarked intersection with the right-of-way just as a farm semi-truck entered the intersection. Unfortunately, M-19 did not survive the collision. - $950,000.00 – Personal Injury – Motor-Vehicle Accident
Female- 49 years old sustained a fractured elbow, concussion, neck sprain, and low back injuries after being rear-ended in a motor vehicle collision. - $500,000.00 – Motorcycle Accident
Male – 32 years old – was riding his motorcycle through an intersection when he collided with the side of a semi-truck running a red light. The collision resulted in the Plaintiff suffering facial fractures, which necessitated open reduction and internal fixation of the facial injuries. - $500,000.00 Automobile Accident
Female – 37 years old – was the passenger of a vehicle that was struck by another car that improperly failed to yield the right-of-way at an intersection in Iroquois County, Illinois. Male – 40 years old – was traveling on a motorcycle when he collided with the Defendant who improperly turned in front of the Plaintiff. The plaintiff suffered multiple rib fractures, a fractured wrist, lacerations to his scalp, knee contusions, and severe bruising. The accident resulted in the Plaintiff having to undergo surgery for an open reduction internal fixation. - $300,000.00 Motorcycle Accident
Female – 82 years old – was the front-seat passenger when the Defendant failed to stop for red light and T-Boned the vehicle in which the Plaintiff was traveling. The collision necessitated an emergency surgery to repair a left corneal transplant wound that been performed 11 years prior and resulted in substantially decreased visual perception. - $292,000.00 Motorcycle Accident
Male – was backing out of an angled parking spot when the Defendant stuck his vehicle, causing the Plaintiff to sustain a subdural hematoma, which resulted in his death several days later. The Defendant’s insurance paid the $25,000 policy limit and UIM coverage covered the remaining $267,000.00. - $280,000.00 Wrongful Death–Motor Vehicle Accident
Female – 40 years old – passed away from injuries sustained when another driver struck her vehicle in Kankakee County, Illinois. Although the Defendant only held a $50,000 policy limit, the Defendant was held personally liable for $30,000. An additional $200,000 was paid by the decedent’s insurance company for underinsured coverage. - $257,348.00 – Personal Injury – Motor-Vehicle Accident
Female- 45 years old suffered a head injury, sternum fracture, and rib fractures after a driver ran a stop sign and collided with her car. After a trial a jury awarded $257,348.00. - $207,500.00 Trucking Accident
Female – 48 years old – was rear-ended by tractor-trailer while stopped for traffic on the interstate. The Plaintiff aggravated a pre-existing back and brachial plexus injuries.
Workers Compensation
- $475,000.00 – Workers’ Compensation
Male – 58 years old – The Illinois Workers’ Compensation Commission approved a settlement of $475,000, in addition to future medical expenses, to a union-represented brick mason whose career was cut short by a workplace injury. He was represented by attorney James Spiros. The injury occurred in Cook County. - $320,000.00 Workers’ Compensation
Male – 42 years old – was a passenger in a semi-truck that struck a 50-car train. The Plaintiff suffered open comminuted fractures to both of his legs, fractures to his face, and burns to his feet. - $320,000.00 Workers’ Compensation
Plaintiff was a truck driver who was involved in a multi-vehicle collision while traveling for work. The collision resulted in the Plaintiff suffering a fractured femur and permanent scarring to his foot. - $300,000.00 Workers’ Compensation
Male – 56 years old – was a union-back heavy equipment operator who injured his back when stepping off a crane into hole. The Plaintiff underwent L5-S1 fusion surgery on his spine as a result of the occurrence. - $254,000.00 Workers’ Compensation
Male – 53 years old – was a union-backed carpenter who fell over an electrical cord and suffered ulnar impaction of his right wrist. - $225,000.00 Workers’ Compensation
Female – 37 years old – was an employee of a sales and collection manager who was instructed to perform inventory. While descending from the three totes that she was standing on, her foot became stuck, causing her to fall and injure her back and neck. The Plaintiff suffered a moderately sized central herniation at L5-S 1 and underwent lumbar surgery. - $214,000.00 Workers’ Compensation
Male – 57 years old – was a factory worker who suffered herniated discs while turning a spool of wire. The accident required a lumbar fusion and the Plaintiff attended post-surgical physical therapy. - $210,719.00 Workers’ Compensation
Female – 48 years old – was a police officer who fractured her tibia while running up steps during a police response. The injury required surgery.
Nursing Home Abuse & Neglect
- $504,000.00 – Nursing Home Negligence
Female – 93 years old – was a nursing home patient who presented multiple bruises to her face, arm, back, and wrist while in the care of the nursing home. It was later alleged that was raped at the facility as well. The Plaintiff successfully sued the nursing home on the basis that staff had ignored signs of abuse and the nursing home’s administration failed to alert the police promptly upon learning of the assault. The case settled for the nursing home’s policy limit. - $275,000.00 Nursing Home Negligence
Female – 82 years old – was a nursing home patient who fell and fractured her hip when leaving her room because the nursing home staff had failed to install a bed alarm, contrary to what doctors had ordered. The injury required surgery with an open reduction and internal fixation.
Medical Malpractice
- $29,500,000.00 – Medical Malpractice and Product Liability
Male- 26 years old- After undergoing a non-emergent medical procedure, our client woke up having suffered a catastrophic and completely avoidable stroke resulting in paralysis and permanent disablement. The settlement was record-breaking in downstate Illinois. - $3,300,000.00 – Medical Negligence
Female – 52 years old – was admitted to the hospital for rehabilitation following a ruptured aneurysm. The Plaintiff was assessed and identified as being at risk for falling given her lack of stability. The day before her scheduled discharge, while attempting to open a bathroom door, a nurse released the Plaintiff, which caused her fall backward. As a result of her fall, the Plaintiff struck her head on a metal bedframe and suffered a subdural hematoma, eventually causing her death ten days later. - $1,668,000.00 – Chiropractic Malpractice
Female- 17 years old suffered injuries to back, spine, ribs, scapula and shoulder when her chiropractor negligently performed manipulations on her. The verdict was obtained in a jury trial. - $1,400,000.00 – Medical Negligence
Female – 42 years old – was improperly administered two doses of Vistaril by hospital staff, which resulted in the Plaintiff suffering from vein necrosis, reflex sympathetic dystrophy, and chronic pain syndrome. The case garnered the highest reported settlement for a case of RSD (reflex sympathetic dystrophy) in the history of Champaign County, Illinois. - $825,000.00 – Medical Negligence
Infant male – 22 month old – while in the NICU, was able to remove his mechanical ventilation without nurses promptly noticing, thereby causing the child to suffer a hypoxic brain injury and resulting in the decision to terminate his life due to the neurological deficits stemming therefrom. The child was diagnosed with Cerebral Mandibular Syndrome at birth, a genetic condition resulting in mandibular malformation and other deformities, which necessitated his hospitalization and mechanical ventilation. - $700,000.00 – Medical Negligence
Female – was admitted to the hospital to induce childbirth and was given Cytotec and Pitocin in order to induce labor. Once admitted, the attending physician failed to complete a biophysical profile or document several risk factors prior to leaving for vacation before the induction of the Plaintiff. Following induction, the Pitocin was re-administered, which resulted in severe fetal distress at time of delivery, nearly causing the child to be stillborn and subsequently resulting in the death of the infant two days after delivery. - $700,000.00 – Medical Negligence
Male – 70 years old – presented for Nissen Fundoplication procedure. During the surgery, the balloon dilator was retracted while still inflated, causing a tear in the distal esophagus. Plaintiff suffered from permanent post-operative complications, including dysphagia. - $700,000.00 – Medical Negligence
Female – 43 years old – underwent open reduction and internal fixation for a fractured ankle, which was performed by the Defendant physician. Following surgery, the Plaintiff experienced continued pain resulting from a broken screw in her ankle. A corrective surgery was performed, during which an intraoperative culture was taken. The culture showed signs of a staph epidermis infection. The second procedure failed to alleviate the Plaintiff’s ankle pain so she underwent a third surgery. During this surgery, another culture was taken, which showed continued growth of the staph infection. At trial, the Defendant testified that he had never viewed either of the reports noting the staph infection. Subsequently, the Plaintiff sought treatment from another physician who attempted to perform a fusion, which provide unsuccessful due to the Plaintiff’s ongoing infection. As a result of the original physician’s negligence, the Plaintiff suffered from CRPS, also known as RSD. - $440,000.00 Medical Negligence
Male – 31 years old – underwent tracheotomy and tonsillectomy at the Defendant hospital’s recommendation following facial trauma to the Plaintiff. The hospital staff failed to secure the tracheotomy tube or adequately monitor the Plaintiff post-surgery. These failures allowed the Plaintiff to remove the tube without being noticed by hospital staff, thereby causing the Plaintiff’s death. - Undisclosed settlement Medical Negligence
Male – 65 years old – was administered fluids through an NG tube that was coiled in his esophagus. The administration resulted in the aspiration of the fluids into the Plaintiff’s lungs and pulmonary system, causing pulmonary infiltrates, significant hypoxemia, and central nervous system dysfunction.
