The claimant filed a workers’ compensation claim for injuries sustained following a slip and fall in her employer’s parking lot. Prior to arbitration, the claimant died of unrelated causes. At arbitration, it was ruled that the Claimant’s estate could not recover accrued permanent partial disability (PPD) benefits because the Claimant did not have any dependents upon her death. The Appellate Court reversed the ruling below and found that the Claimant’s estate could seek and obtain accrued PPD benefits that were payable, due, and owing to claimant prior to her death, regardless of dependency.
